Terms of Service

These Terms of Service ("Terms") govern access to and use of the website beauscaled.com and all services provided by BeauScaled, a sole trader based at 10 Park Crescent, Falmouth, Cornwall, TR11 2DL, United Kingdom ("BeauScaled", "we", "us", "our"), including AI voice agents, lead reactivation, website development, and other AI-related build services (the "Services"). By purchasing, accessing or using the Services, you ("Client", "you") agree to be bound by these Terms.
1. Services
BeauScaled provides AI-related services for businesses and individuals, which may include:
- AI voice agents that answer calls and book customers
- Lead reactivation via automated SMS and email outreach
- Website development and design
- Other custom AI-related builds and integrations as agreed with the Client
The exact scope of Services is as agreed with you at onboarding or in a separate order/quote, which forms part of these Terms.
2. Eligibility
The Services are intended for individuals and consumers aged 18 or over. By using the Services, you confirm you meet this requirement and have the authority to enter into these Terms (including, where relevant, on behalf of a business).
3. Free Trial, Fees & Payment
- Free trial: New clients receive a 7-day free trial of the Services.
- Setup fee: A one-off setup fee applies following the trial period, to cover configuration and build of your Services.
- Subscription: Ongoing access is billed monthly on a recurring basis via Stripe.
- Cancellation: You may cancel your subscription at any time, with no notice period required. Cancellation stops future billing; fees already paid (including the setup fee and the current billing period) are non-refundable, except where required by law.
- We may change our pricing for future billing periods with reasonable advance notice.
4. Client Responsibilities & Acceptable Use
You agree to:
- Use the Services only for lawful purposes;
- Ensure you have the necessary consents and legal basis (including under PECR and UK GDPR) before we contact your customers or leads by phone, SMS or email on your behalf โ you remain responsible for compliance with telemarketing and electronic communications laws for your own customer/lead lists;
- Not use the Services to send spam, unlawful robocalls, harassing, fraudulent, defamatory or illegal content;
- Not attempt to reverse-engineer, resell, or misuse the underlying AI systems, software or tools used to deliver the Services;
- Provide accurate information needed to configure and operate your Services.
We may suspend or terminate the Services immediately if we reasonably believe they are being used unlawfully or in breach of these Terms.
5. Intellectual Property
- Deliverables built specifically for you (e.g. your configured voice agent, website, and messaging workflows) are licensed to you for use in your business upon full payment of applicable fees.
- BeauScaled retains ownership of its underlying frameworks, tools, templates, know-how and any pre-existing intellectual property used to build your Services, and may reuse general, non-client-confidential methods and components for other clients.
- You retain ownership of your own brand, content, and business data provided to us.
- Neither party may use the other's trademarks or branding without prior written consent, except that we may reference your business name as a client reference unless you opt out.
6. AI Output & Service Disclaimers
Our Services rely on AI and third-party providers (including hosting, payment, CRM/messaging and voice/AI infrastructure providers). While we configure and monitor these systems carefully:
- AI-generated responses, transcripts and messages may occasionally be inaccurate, incomplete, or not perfectly reflect your intended messaging ("AI misstatements"), and we are not liable for any loss arising from such inaccuracies;
- We are not liable for missed calls, delays, or service interruptions caused by outages or downtime of third-party providers (including but not limited to Cloudflare, Stripe, GoHighLevel, telephony/voice providers, or your own phone/internet service);
- We do not guarantee any specific business outcome (e.g. bookings, revenue, or lead conversion) resulting from use of the Services.
7. Limitation of Liability
To the fullest extent permitted by law, BeauScaled's total liability arising out of or relating to the Services shall not exceed the total fees paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential losses, including loss of profits, revenue, business opportunity, or data. Nothing in these Terms limits liability that cannot be excluded under UK law, including liability for death or personal injury caused by negligence, or fraud.
8. Suspension & Termination
You may cancel at any time as described in Section 3, with no notice period required. We may suspend or terminate access to the Services immediately for non-payment, breach of these Terms, unlawful use, or abusive behaviour towards BeauScaled or its systems. On termination, your license to use client-specific deliverables built under these Terms ends unless otherwise agreed in writing.
9. Changes to the Services or Terms
We may update these Terms or modify the Services from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
10. Governing Law & Disputes
These Terms are governed by the laws of England and Wales. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that either party may seek injunctive relief in any court of competent jurisdiction where necessary.
